If you haven’t filed your past due tax return, it's important to act quickly to avoid IRS late filing penalties and limit interest charges. The longer you wait, the more you could owe in penalties and accrued interest.
If you're owed a tax refund — from federal withholding or estimated tax payments — you must file your return within 3 years of the original due date to claim it. This same rule applies if you're eligible for tax credits such as the Earned Income Tax Credit (EITC). Miss that deadline, and you forfeit your refund or credit.
Unfiled tax returns can also affect your financial life. Many loan applications, including those for mortgages or personal loans, require proof of filed tax returns. Not filing can delay or even prevent loan approval.
Beyond financial consequences, failing to file a tax return can expose you to potential criminal charges. Willfully failing to file is a federal offense and may lead to criminal investigation, prosecution, and even jail time in serious cases. The IRS may view multiple years of unfiled returns or large unpaid tax balances as signs of tax evasion or fraud.
In some cases, if you don’t file, the IRS may file a substitute return on your behalf. This often results in a higher tax bill because the IRS won't include deductions, exemptions, or credits you may qualify for. You’ll receive a Notice of Deficiency (CP3219N), also known as a 90-day letter, giving you limited time to respond before the IRS finalizes the assessment.
